Hi in need of a bit of advice and wondered if any one could help. We own a ground floor flat that is a converted Victorian house its leasehold and the freeholder lives in the first floor flat. We own the side garden (its a corner house) and he owns the front garden and the small yard at the back. We legally have access rights through the front garden to get to the front door/porch. Our issue is, he started 'work' on the front garden nearly 15months ago and has stopped half way through. My partner has offered his 'services' to get the job finished but the freeholder doesn't seem to be willing to purchase the materials needed to finish it. Its unsightly, its flooding in the rain and becoming a mud bath and its a hazard. The 'temporary' flags he's put down aren't set in, they're uneven and have huge gaps between them. We call them 'craters' its that ridiculous. Our 2 kids are constantly taking a tumble on them because of how they raise and dip and my little boy ended up with stitches last month after falling over on them. Our house is on the market and obviously this puts people off which is no good in this poor market anyway! We just want to know if there is anything we can do to get it sorted??? So fed up! I think he's hoping we'll get so fed up with it we'll pay to have it fixed/finished!

Hello Ema lou .If you think that the messy front on the property is stopping you from selling your`s, i would do it myself just to sell and get out of there. I know it`s the principle here but principle`s wont sell your house .Good kuck any way June

you need to check the law cos if its your only access point to your property, are you sure he owns the land, check on the deeds i think you can find them on the web there are lots of sites you can use otherwise go to the land registry office. Also if its a shared access then he has no right to start anything without your permission, and also if he does own it but it is also a legal access i think he has to keep it to a certain standard. Im not a legal person so dont take my word for it, but its certainly a starting point anyway.

Thanks phk68bay! We've got an appointment with a solicitor who specialises in lease hold properties next week as we want to discuss either buying the freehold rights or extending the lease anyway so hopefully we might eventually get it sorted!
