Hi - quick question

If refuse bins are stolen ,who is liable for paying for replacements ?

1/ tenant who pays council tax
Or
2/ landlord who supplied bins in the property at the start of the tenancy

Have a friend who is in dispute with landlord

Hi, I had the same problem when I moved into my house, someone had taken my bins, so rang the council who told me it was down to the landlord or I could pay £37 for each bin. I certainly wasn't payin £74 for 2 bins that's just ridiculous.

Don't see how the tenant should be liable, it's not like they'll take them with them if they ever move oshocked

I remember coming home years ago and finding my green bin had disappeared on the day the bin men had been. I rang up the council and the nice girl on the phone said maybe it had fallen into the wagon and arranged for a new bin to be sent out. That maybe about 10 years ago.

She seems to be getting 2 different answers
I can see it from the landlords point - just say it happens every week !
but I also thought they would be part of the property so its not the tenants fault
She is responsible for the upkeep of the interior of the house whereas as the landlord is responsible for the exterior
Only people who seem to benefit is the council who want £44 per new bin !

I have seen the bins on Ebay and one went for £10 last week.

i had this problem when i moved someone had robbed mine, phoned council to be told a hideous amount of money was required for new ones so i stuck someone elses in back of my van and had them away

I would have thought it to be between the bin user ie the tenant and the service provider, the council. Before we had wheelie bins we all had to buy our bins from the "chandlers" or similar. Our landlords never bought us a bin. Wheelie bins were then issued to us by the council not landlords.

I think the law would say tenants responsibility, crap I know but don't see how it's Landlords fault.

But its not the tenants fault either.. I think a man with a quick van to an empty property with a few bins outside would be the best bet.
