Examples of real life cases, from RMNJ
  • Example 1.
    Mr A was driving his car when another vehicle driven by
    Mr B pulled out of a side road into his path and a collision occurred.
    There was no dispute that the accident was Mr B’s fault.
    However, Mr A was not wearing his seatbelt and it was accepted
    his injuries would have been less had he been.
    Mr A still recovered substantial damages albeit there was a reduction
    in these by a small percentage on the basis Mr A was not wearing his seatbelt’.

  • Example 2
    ‘Mr C was driving along a main road above the applicable speed limit
    when Mr D pulled out of a side road into his path and a collision occurred.
    Mr D was still found liable despite Mr C driving above the speed limit
    and his insurers had to pay full damages to Mr C’.

  • Example 3
    ‘Mr E was driving his car when Mr F drove into the rear of him.
    Mr E was driving his car without insurance, Mr F had insurance.
    It was accepted that the collision was completely Mr F’s fault and
    Mr E’s lack of insurance did not prevent him recovering damages
    for his full losses from Mr F’s insurers’.

  • Example 4
    Mr G was driving along a main road.
    He was approaching a side road on his left hand side,
    he accidentally activated his left hand indicator.
    Mr H who was waiting to turn right out of the side road
    Mr G was approaching relied on the indicator,
    believed Mr G was going to turn in to the side road and pulled out into Mr G’s path
    and a collision occurred.
    Despite Mr G’s misleading signal, Mr H was still found
    principally to blame although Mr G was found partially at fault.
    Both Mr G and Mr H recovered a portion of their losses’
