Car A is travelling down a one way street in the correct direction at under the speed limit,
Car B has just parked up.
Car A proceeds to pass the stationary Car B
Car B opens driver door and makes contact with rear door of Car A making quite a lot of paint damage.
Car B then blames Car A for the contact and accuses them of speeding.

Who's to Blame?

Car A should anticipate car B Opening its door and given it a wider passing.

to an extent i agree with u AX, but 1) the road might be to narrow to allow wider passing, 2) it was the backdoor that car A caught so given both those two points i would say car B as car A has already started passing car B. also car B should have used their mirrors. they arent there just for when u are moving

its a 1 way road with cars parked both sides only allowing single file traffic down it, to give you a perspective, you would struggle in a transit. i.e no room to move over.

Thanks Guys,

I said to her that the other car was liable, but she was worried and didnt want to claim through the insurance if it was her fault, as the other car has no or little damage.

i would say car B coz if car B had useed there mirrors correctly then they would no there was a car comeing

she was in car A,

MSN is signed in at another computer and wont let me sign in on this one. think its at my parents.

ahh lol, weird, usually it lets u sign and and automatically signs u out at other destination. anyway i personally think she should go for it, regardless of the amount of damage to the other car. any reasonable person would see that they were the root cause

Well the rear side got scratched or damaged on Car A, so car A could not have avoided that accident as Car A is unaware that Car B is to open the car door therefore Car B is at fault for not checking his/her observation with the knowledge that Car A is behind.

Clearly as others have said Car B is at fault

Car B is a Fault 100%
Even more so because you mention that its the Drivers Door
that is opened so as a driver knows only too well that
the road could have on coming traffic.

Speeding or not the damage would have been the same.
As they obviously did not check for traffic before opening the door.

We cant all drive along assuming that a door will open or
we will be moving at 2mph.

Thanks LTI, all has been resolved now, Insurance companies holding Car B to blame (the car that opened its door). As we all said in the 1st place.

unfortunaltly you can no longer make a personal injury claim for shock, stress, loss of confidence etc.
