bought jacket from ethels last wed took back yesterday said i could not have refund as they are in adminstration .so ended up swopping for cushions which i don't really need .are they allowed to do this . they where still selling so why can't they not refund ?

Shops don't have to give refunds if the item isn't faulty, if they do it is a gesture of goodwill. Sounds like if they weren't in administration you would've got a refund, you were unlucky I guess, but at least you have cushions instead lol. On the other hand, if it was faulty then you are entitled to a full refund or replacement.

Am pretty sure that when a company is in recievership any money that comes in is the recievers and therfore is not Ethel Austins money to give back. I'm pretty sure thats how it goes.

I am not sure if all the stores are closing. I think about two-thirds are. I suppose the only one which won't be affcted is the one in the Liverpool City Centre. Birkenhead and Wallasey will be earmarked for closure. I seem to recall Ethel Austins going into administration a couple of years ago but was saved. Have to wait and see if it can be fully saved.

primark took customers from ethel austins as it's got more selection and style .thats what the manager told me . think she right

They called in the administrators a couple of years ago and managed to struggle on til now.

You can opt for a refund so if they told you that you can't, they are incorrect, but as per the administrators instructions, you will become a non-priority creditor of the company, and will be well down the line in getting a payout if and when they are finally wound-up. So they cannot give you a cash refund regardless. The administrators are there to gather up as much capital as possible to pay creditors, not to lose money.

The reason they are still selling goods for cash is because the goods they have on the shelves and in the warehouses etc, are assets, and the administrators will attempt to sell-off all assets in a bid to pay the companies creditors.

Unusually, the administrators are also accepting vouchers for payment, upto 50% of the total value of the purchase iirc, normally they don't accept anything but cash and voucher holders simply become non-priority creditors, so it suggests there may well be a small hope that a buyer for the company will be found.

Hi, I work in an Ethel Austins, and yes, we are actually not allowed to give refunds at this time. As we've gone into administration anything that goes on has to be confirmed by the administrators, who have said that we are not allowed to give cash or credit refunds at this time.

Typical, it's us, the shop staff, however that have to tell the customers that we cannot give them they're money back and it's causing a lot of problems to be honest.

If you do want your money back however then you can get contact details for the administrators in any Ethel Austins shop, but at this time I think they will probably be a little more strict on the rules.

As for shop closures, the shops in Upton, Prenton, Liscard and Neston are all confirmed to be closing. Not too sure on the Liverpool Central shop, but I think the smaller one is closing as well. The company still has no buyer as of yet though so they might still all close.

Hope this clears things up! Don't hate the staff, we're just the over-worked under-payed skivvies carrying out some poorly judged orders frown
