I'm going to assume you didn't actually go to any of the attic sales seeing as you would know that there was very little new stuff to say the least. Vast majority was second hand and even a few crafts in there so in answer to your question... no.

there shouldn't be any new stuff..never mind very little..check the rules with the council..new stuff is sold in markets and shops not at attic sales....I went to your first sale but like when I went to Tranmere Rovers car boot there was lots of new stuff on sale so don't assume things Dave

I wouldn't care if there was some new/unused stuff so long as I wanted it and it was a great deal cheaper than in the shops/market.

Organiser, I only assume as you focus on 'new items' which is extremely unfair on those selling second hand items as well as the community centre who enjoy an income from the sales as well as customers who would like to come along but are being put off as you insinuate there is a large amount of new items which there clearly isn't.
With regard to the sale of new items at an attic sale, unless the sale is held in open air on land which permission or a license is required from the council there is nothing stopping people selling new safe items much like at specialised fairs and shows as per Sale of Good Act 1979, Consumer Protection Act 1987 which require only that items be safe and that there be a form of recourse which at my sales there is seeing as we take bookings rather than people just turn up. Also bear in mind most legislation refers only to open air / car boot sales and not enclosed sales with restricted access within private premises.
Even at a car boot sale if large numbers of new items are on sale this should in good practice be in a designated area noted as a 'market area' but this is not required at smaller and indoor sales.
I did do my homework before starting the sales.
Now I am done arguing over this and your insistance on making negative comments is doing no one any favours.

You are obviously the sort of person who enjoys seeing the likes of HMV closing down with the loss of thousands of jobs because there is a cheaper alternative via the internet with downloaded and sometimes illegally so music.
Genuine market traders, ie at Birkenhead market, pay not only massive rental fees for their stalls, but also water rates and electricity charges for the right to sell their new goods
Your stance as far as attic sales are concerned and pompous "I know it all attitude" in relation to "your homework" shows a total disregard for the traders who are currently standing in ice cold conditions in local markets, Birkenhead, Neston and Ellesmere Port to quote three, struggling to sell the goods that they depend on selling to make a living for themselves and their families, the same goods which you think it is acceptable to sell at your attic sale
Shame on you sir!!!!

You're being an a**hole, I think that's what that comments all about.. Stop attacking another member for posting about his attic sale. If its perfectly legal for people to sell new goods then I struggle to see what it has to do with you. And if you are truly so bothered about the people who rent out market stalls go and tell them about this attic sale where they only have to pay a tenner and they can sell their new goods and probably in warmer conditions.

What a lovely expression Turnip....an attic sale is exactly what it defines itself to be...in my experience if I buy goods from a market stallholder at any of the markets defined I will get a receipt with the name of the company at the top, the date of the purchase..the description of what I have bought and the cost..I am therefore covered by the sale of goods act 1979 and can reasonably expect to have bought goods of a decent quality and have recourse by law the the seller if the standards are not met...I will go to Moreton tomorrow and see if the new goods which will definitely be on sale carry that sort of qualification.

Organiser... they don't start again til next week as per my original post and people do have a recourse under Sale of Goods, as I said in my previous post, as I take bookings for tables rather than allowing people to just turn up and so contact details are taken at the point of booking meaning I can put customers in touch with sellers. Seriously, knock it off. Stop being so damned petty minded.

In addition the Sale of Goods Act 1979 only applies to traders so if a seller sells a new items among second hand they would not be considered a trader. In fact this would only apply if the person has bought new items in order to sell on and not if they have been donated or are simply unused / unopened.
If a seller sells mainly new items which they have bought for sale then they would come under the act in which case the consumer would be put in touch with the trader. If there are found to be significant problems with a seller they would be prevented selling again and the consumer would have the option of approaching trading standards.
Agreed that second hand items are preferred as that's what most visitors are looking for but there isn't any reason to prevent the sale of new / unused items. Happy? I'm guessing not.
