Be careful of any advice you obtain from the CAB in regards to Debt & Bailiffs, as some advice you may receive could put you in a worse situation.

For example not fully advising you on what the bailiffs can and cannot do.

How old is your daughter, if she is over 18 they definitely can't touch your property. I'm not sure on the answer if she is under 18.

Are you sure you never signed anything as a guarantor?

This isn't entirely true. They can still lawfully Levy on items outside the household. If it is the First visit. The Bailiff will simply be looking to Levy items inside and outside the household, and not take anything. You will be asked to sign a walking possession order, allowing them legal access to enter your home a 2nd time without your permission (and use a locksmith if needed)

If you do not open the door to the first visit, they again, will simply levy on items outside, and because you have not signed the walking possession, your bailiff fee's will increase a large amount.

On Priority debt, such as council tax, child support, road tax's, your debt file may be returned to the client who sent your details to the bailiff, and you could be liable to further action, for example Deduction from earnings or even a prison sentence in some cases.

Again, if you have signed the walking possession on the first visit, they can legally use a locksmith to enter your property and remove all goods on the original Levy. Bailiffs tend to get police to be in attendance while they remove products.

They can't break into your house if you have no walking possession signed, they can only use openings that they find on your house, for example an open back door, window or sky light.

If goods have been Levied on outside, they can remove them if you refuse them in. However, if these items do not cover the amount of your debt, and bailiff fees, then you're leaving yourself open to further action

This thread is almost a year old, however, couple of points:

Bailiffs have set hours they can operate and enter your home, 6am is outside those hours.

Bailiffs will claim that if you open the door to them they can legally enter, push the door open or stick their foot in it. Again this is untrue, no matter how many times they claim it is.

There are fixed maximum fees that bailiffs can charge per visit, these are much (much) lower than you would think, and a LOT less than they will try to charge you.

The debt belongs to the person, not the property and not their relatives. If she doesn't live there you tell them to leave, forcibly if required.

Police ARE NOT there to assist the bailiff and can be reported if they do, their ONLY reason for being there is to prevent a breach of the peace.

Under 18's cannot legally enter into any contract in their own right (without a court authorising it) so any debts from an under 18 are invalid and unlawful from inception, even if they have now reached 18 or over.
