Heres the crack, i`ve got a flat which i`m waiting to move into, problem is the old tenants are still there and were meant to be out today (they were given 2 months notice) they have not been paying all the rent, ones working, the others an alcoholic on the benefit system. They have apparently done a lot of damage to the property in question (he spent £4000 on it last year)
The landlords worried and won`t let anyone smirk `kick them out` in case he gets into trouble (very polite chap, everything by the book)
He said it could take upto 4 months to get a court order to have them evicted [Linked Image]
Is this the only way?
Any ideas?

Apart from using physical violence...I can only advise..

Under the Housing Act 1988, a landlord who has granted an assured shorthold tenancy has a legal right to get his property back at the end of the tenancy. In order to invoke this right, he is required to follow the correct legal procedure which includes service of a notice (under section 21 of the Housing Act 1988) on his tenant. Section 21 is divided into subsections with different rules applying to notice served during the fixed term of a tenancy and notice for possession that is served during a statutory periodic tenancy.

In other words, sadly, it has to be done via court orders.

Kick the door in and smash them....

On a serious note bud if he can proove that they are in breach of their agreement (damage to property etc etc) then he should be able to have them rmoved very soon. Other than that I suggest he pays some heavies to scare the living day lights out of them. I happenen to know people like that but it will cost him, but maybe not as much in the long run so to speak.

Think it costs the landlord about 150 to get the court order. Maybe he just doesn't want to pay out think

a freind of mine had a similar problem with some tenants of his.his solution was quite radical but worked.he got a gang of lads that he knew and supplied them with lots of booze and a stereo system,they moved into the house for a weekend and had an almighty party. a very loud party,more booze was supplied on the sunday morning and the party raged on from the friday night.early morning on the monday the "tenants" moved out without a single hint of any violence.the party finished around 11.00 am on the monday and the owner began the process of cleaning up.

laugh Thats a good idea phalinmegob, i like that but the problem is its a large semi- detached made into 2 flats, i have to think of the neighbours next door who have a daughter and young baby and the other nieghbours, it`s quite a respectable area and i don`t think the neighbours would be to happy, lol. I had a few friends around last night and those idiots from upstairs had the cheek to bang on the floor probably because we were talking to loud! They were ignored of course! snob
(I`m currently in the ground floor flat looking after it for a friend)

Nope, I`ve spoken to the landlord, he wants me in soon as they`re out and the place has been fumigated/repaired whatever, he has served them 2 months notice which runs out today (31st Jan) and he said they have not been opening the door to him and that if they were not out today that he shall be seeking for a court order on monday to get the ball rolling for eviction procedures. He`s unclear on how to do this.

Thats what i suggested to him mate, but he said no, he has to do it the legal way in case he gets into trouble.
I can understand as he is about 75-78, very well spoken chap, not the kind of person to use force and does everything by the book.
