Hi guys I was just wondering if anybody can give me some legal advice regarding my neighbours.I have recently moved into a new rented property as my previous address is being demolished to make way for a new development.
My neighbours have been pains in the arse from day one starting with locking me out of my own garden (which I need for the dog) and are being totally arrogant.Now they are complaining about me to the council who have told them to keep a diary on me.Thay are making up a load of shite saying I'm throwing parties and the likes and I'm also abusive towards them.This is a load of bollocks.Thay called the police on me when I tried to access my garden saying I kicked their door instead of knocking,but I totally didn't.
Can anybody give me some advice about this because I feel like my hands are tied behind my back and the council seem to be siding with them.
Any help would be great thanks.

P.s I have even tried to make amends with them because nobody wants to be arguing with their neighbours,but it was threw back in my face.

Is this housing association/council? If so you should get onto them and record your side of the story. Also if they are going via an ASBO team at the council you should get in touch as well and state that they are making claims against you. Of course one person's idea of a party may be just that you are playing your music past a certain time in the evening with a small group of friends.
Have you tried talking to the neighbour or is it beyond that? You could maybe write down your feelings in a letter? Your neighbour's cannot block your access to your lands. Maybe state this in a letter and say that you will be seeking legal advice - whether or not you actually do will hopefully suggest to them that you aren't stupid.

If its private landlord you should contact them and explain what is going on. They may be able to mediate on your behalf (if they have any sense). I'm sure your landlord has a duty of care. Check your tenancy agreement.

At the end of the day if the neighbour's claims are unfounded they are getting risky - defamation of character/slander etc.

Feel for you bud, nothing worse that having an appology thrown bk in your face. I dont think you'll ever make peace with these loosers so as snooze says just keep your own diary and try to avoid any contact what so ever with them.

Is it possibly Homophobic ?, are they like that with other neighbors, and try and find out what were they like with the previous tenant that was in your property. It might be a usual thing with them.

It is quite possible that they have had nightmare neighbours before you and are now highly sensitive to the least bit of noise etc.

Apply to the local ASBO team for 'report forms' and start sending them in whenever these neighbours are not nice - remember everyone has a different level of what they would consider to be 'harassment/abuse' - all levels should be taken seriously. If this is affecting your enjoyment of your property - rented or not - you should be able to express that.

Thanks guys. The neighbours in question own their property but the previous council tenent in my flat was her sister (hence they ripped the dividing fence down) It's making me ill seriously,It's just stress everyday.Could possibly be homophobic as they are a stuck up couple i'd say in their late fifties (but he wears a pinky ring.)I don't know how they would find out I am gay as I certainly don't push it in peoples faces.I do know that he put in for this flat (probably so they could have the whole building and gardens.
The so called party was on my birthday and it was just me and my other half decorating and having a few drinks.Seriously guys I think they are trying to provoke me into doing something daft to them.

If they own the property then they may also own the land? People get very protective with something they own. Never wanting to share.

Talk to your Housing Officer. Get your side of the situation across. Keep any letters. Kill your neighbours and shit on their dead corpses.

Ignore that last one cos its quite illegal.

OK - if the council is your landlord you seriously need to tell them about this situation. Sounds like they are throwing their toys out because they wanted the flat.

If it is making you ill you should also report this to your GP. If the council ever wanted evidence of it causing you ill health, they would have your permission to check with your doctor and it would be there on record.

DOn't let the barstard grind you down - been there myself and had a thousand murderous thoughts.

Oh yeah and get the fence put back up - if its a party boundary the council is responsible for your half.

My mum has always said that when homosexuality was illegal,men used to wear a pinky ring as a kind of code to say they were gay.I wore one once and she hit the roof telling me I shouldn't advertise it.How true it is I don't know to be honest.Lol Paul mate, I have considered something along them lines,but thay don't own the land and have admitted this to me.They say they are locking me out for security reasons.but still they have no right to lock my garden aswell.

There is a ticket on for the fence but I doubt she will let them in to fix the issue.I kinda hope she doesn't cos then the council will see they are just being arses.

Chris, on the deeds for your place, and therefore in your agreement, there should be a clause delineating who is responsible for the fencing. If they knocked a fence down then they may be responsible for replacing it e.g. on my deeds I am responsible for the west, north and south boundaries and next door is responible for the east boundary fence (it's now a wall but whatever), that may be worth looking into to get your fence back. Sorry to hear you are getting bother mate if you are just getting on with your own life, uncalled for.

Did they get the council's permission to take down the fence? They should have regardless of one of their relatives living there. They could be done for criminal damage of council property.

OK, I'll stop now - my frustrated, evil side is rearing its head. I know how infuriating crap neighbours can be. I used to dream of doing stupid things like leaving a dead fish on their doorstep, or eggs, so they'd slip and break their necks on them. I also used to think about going through to their attic, drill a tiny hole in the ceiling and dripping poison onto them while they slept (Grosse Pointe Blank?). My most entertaining thought was sticking a nozzle through the letterbox and injecting expanding foam into the house until I could see it pressing up against the windows devil

Cheers Bandycoot,will take a look at that shortly.I honestly think it's sour grapes and a bit of snobbery. They look down thier noses at me for no reason whatsoever and I think they think I'm a scally scouser,who will burgle them or something.She's like the one on the mobility scooter from Benidorm and he just looks like Archie Mitchell off 'enders,who annoys the sh**e out of me anyway.I feel better for venting my spleen over this so thankyou very much guys for all your advice and support. happy happy as sometimes it gets lonely up here boo hoo lol
