9.1.3 Uploading / content : Do Not Upload to our server, copyright, offensive, illegal, pornographic material. You are responsible for its legal content and the permission for it to be uploaded to our server. wikiwirral.co.uk are not responsible in anyway for the protection of any data protection in a image uploaded i.e. car registrations, door numbers, telephone numbers, faces etc.
9.1.4 Under the age of 18 years :
wikiwirral.co.uk does not allow membership to a person under the age of 18 years. You agree that you have entered the correct date of birth upon registration. We accept no liability if you provide inaccurate information. Your Member account will be removed if proven to be under age.
9.1.5 Commercial advertising is only permitted providing a listing fee has been paid in advance and authorised.
9.1.5b For Sale Items : wikiwirral.co.uk allow users to use this area to advertise items for sale but are not responsible for any transactions between members. We do NOT get involved in any disputes between members. We do NOT act as a 3rd party. Items listed should be in full working order or stated otherwise. Any agreements made are solely between each individual. Items not suitable will be deleted with out notice.
9.1.6 Private Messages :
You agree These are private between senders and the content is not to be displayed in the public domain or our forums. You should not divulge copy, forward or use the contents, attachments or information in any way false, misleading, racist, derogatory, or otherwise offensive matter. Please read our Privacy agreement.
9.1.7 : Recommendations / Grievances : We do not allow any grievances to be posted about a person / company / business listed within our forums. Customer complaints should be resolved with that company's complaints procedures. Failing that, Trading Standards or Small Claims. Our forums are not legally under UK law permitted allow defamatory statements. It is a criminal offence. Your account may be restricted and reviewed before we grant you access back on our forums.
9.2 You may not use the chat forums or any of our comms systems for any illegal purpose and in particular you will not:

9.2.3 continue to disrupt the normal flow of dialogue, or post or transmit comments that are not related to the topic being discussed; (Spamming)
9.2.4 post or transmit chain letters or pyramid schemes; (Spamming)
9.2.5 impersonate another person (Trolling);
9.2.6 To use a second account maliciously;
9.2.7 post or transmit any files containing viruses or other harmful computer code;
9.2.8 harvest or otherwise collect or use information about others, including e-mail addresses, without their explicit consent;

9.5.6 edit or remove any communication(s) posted on our web site, regardless of whether such communication(s) breaches these Terms.
9.6 If you disagree with a decision of a Forum Team member, you should email your appeal to Click Me. You must not use the chat forum to argue any decision of our Forum Team.
9.7 Any decision we make to remove or request the removal of any communication or to terminate or suspend the posting privileges of any user of the chat forms shall be final and binding. The termination or suspension of posting privileges shall apply to any and all user accounts that may have been used by that person, whether or not opened by that person.
9.8 If you are notified that your posting privileges have been suspended or terminated, you will not attempt to reregister as a user of the Chat Forum or make any posts on it in any guise whatsoever.
9.9 When former users whose posting privileges have been removed do reregister or otherwise disrupt the Chat Forum, this spoils the Chat Forum and can cause severe distress or disturbance to other users. Dealing with the unwanted posts of former users distracts us from the core purpose of the site and ties up management and technician time. Therefore in such circumstances we reserve the right to:
9.9.1 Report offenders to their ISP
9.9.2 Charge offenders for the administrative costs of identifying and removing their posts at the rate of £40 per hour necessarily spent plus any external costs that we incur.
9.9.3 Take legal action to recover these costs.
9.9.4 Report offenders to the authorities if their actions appear to amount to a breach of the Computer Misuse Act 1990 or any other relevant criminal legislation.
|10. Membership Subscriptions.|
|10.1 Payments are in Advance via PayPal with a Membership Subscription.
10.2 Refunds / Compensation / Recurring Payments. We do not compensate or refund for an Account Status Change (Suspended or Removed), Disruption or Restriction of Service / Access. Subscriptions are Automatically set to Recurring payments by default, this is your responsibility to cancel via your pay pal account if you do not wish to pay automatically in the future. Failing to Cancel a Recurring Subscription Payment does not warrant a refund.
10.3 If the initial payment request fails, we automatically reattempt 3 days later and then 5 days after that before finally cancelling the Membership Subscription automatically.
10.4 We do not offer a service level agreement with any of our subscription services.
10.5 Upgrading a Subscription we are unable to Refund your existing Subscription.
10.6 Subscriptions are not Transferable Between Members Accounts.
10.7 The Permissions and services available to Subscription Accounts are subject to Server and Software Limitations. There maybe times that our server or software changes, result in a privilege being removed as a Service may no longer exist or Is Deemed to have a Negative impact on the server or software.
|11. Local Traders : Advertising|
|11.1 All Normal Terms and Conditons Apply.
11.2 Local Trader Accounts are Required to Advertise within wikiwirral.co.uk
11.3 wikiwirral.co.uk does reserve the right to remove Adverts and Membership without notice.
11.4 Advertising is payed in Advance. (Non Refundable).
11.5 Advertsing will be removed if payment is not recieved and a Admin charge applied for reactivation.
|12. Local Traders : Advertising|
|12.1 All Normal Terms and Conditons Apply.
12.2 Banners must be approved in advance, and not changed without approval.
12.3 wikiwirral.co.uk reserves the right to remove Adverts or Banners without notice.
12.4 Advertising is payed in Advance. (Non Refundable).
12.5 Advertsing will be removed if payment is not recieved and a Admin charge applied may apply for reactivation.
12.6 Banners must not contain any nudity, sexual meaning, swearing or graphic nature.
12.7 We do not offer a SLA Service Level Agreement for uptime.
12.8 We reserve the right to charge for updates etc.
12.9 Banner Sizes are predifined dimentions and must not exceed the agreed dimentions.
|13.1 You agree to indemnify, defend and hold harmless us, our directors, officers, employees and licensors from and against any claim, liability, cost, damage or loss we may incur (including reasonable legal fees) as a result of any material that you post or transmit on our communication forums or via our comms systems, any actions you take which disrupt access to and/or the functioning of our site or any breach by you of your obligations under these Terms.|
|14.1 If any of these provisions is deemed invalid, void or unenforceable that provision will be deemed severable from the rest and will not affect the validity and enforceability of any remaining provisions.
If there is any conflict between these terms and specific terms appearing elsewhere on wikiwirral.co.uk (including Community Rules Individual Forums) then the latter shall prevail. If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and effect and continue to be binding and enforceable.
