I wonder if it will work. I think they are doing it in the hope that Viacom drop the charges, I hope they don't though, its about time these big companies were forced to take responsibility for copyright infringements, if its a normal person infringing on copyright they get fooked, but because its a huge corporation, they have been getting away with it for years.

You Tube should have put procedures in place to monitor its videos.

Yes both uploader and YouTube are at fault but they should have had some sort of vetting procedure to see if the video is ok or not. Metacafe has a downloadable client where new videos are sent to your pc and there is an option to review new items.
