Was coming down Heath Road at 30mph towards the roundabout near the Rose & Crown tonight. Went round the roundabout and my gfriend went 'oh s**t' and then a Focus flies in front, and I go into the side and spin round.
I honestly don't think the bloke saw me until I went into him.
Typically, he refused responsibility until I pointed out I had front end damage and he had a miniscule dent in his wing and got a witness. The damage isn't much, but will be claiming on his insurance purely because he didn't take responsibility at first - I wasn't going to claim originally.
Silly Welsh tit.

omg what a pain in the bum! i hate careless drivers, they should be shot lol. im fully comp with my insurance so its not too bad if i have a bump (touch wood) but its just soooooo annoying when people dont admit fault when its blatently obvious its them who caused the crash, grrrrr it makes me so angry. not only that but its a pain when your car has to go into the body shop for a few days to get fixed and its through no fault of your own, what a ball ache mate. i feel for ya! oh yeah hows yours and your gfriends neck? i bet its really hurting you both eh.

sorry to hear about the crash mate, what car were you in, another vauxhall hurt?
Posted By: DavidB Re: Blind, careless driver crashed into me - 20th Aug 2006 11:21am
Yeah, ours necks are starting to hurt a bit now. laugh
I was in the Astra, it was the Rose and Crown in Bebington (near Maher Park). Basically, I hit the Focus's wheel with my front corner. He had a dent and probably a scuffed alloy, but that's it.
My bumper is knackered, need new wing, I've pulled the frame out, and I need a new indicator. Not a lot, but bumpers aren't cheap and I'm not paying for a new one. I was expecting a lot, lot worse.

The red Gsi???? noooooo

Gutted for ya mate.DONT let the insurance write it off

It was the GSi, but it's only a new bumper.

There's an update on this:

Update on this.
I received a letter this morning from the driver saying he wants 'to pursue a claim for losses sustained in the above accident which our client alleges was caused by you or your driver's negligence'.

Can you believe it?!

did u swap insurance details?
inform ur insurance immediately?
get any witnesses details?

once ur solicitors speak with theres and witness testimonies move round the other party will lose.take em for all they got.

How did this happen, did u enter the roundabout into him,or vice versa,or was this AFTER the roundabout?

[Linked Image]

Did all the formalities, and I was only going to claim on a new bumper as I've bought all the rest of the stuff.
It was in the roundabout, I had entered, was going round and somehow he didn't see the car, even though it was 'give way' and went straight through colliding with the car (mine) right in front of him. It was only down to my GF saying 'oh sh*t' that I steered away and spun after he hit me. It was the same type of thing as driving down a road and someone pulling straight out in front of you.

As I see it, he hasn't got a leg to stand on as I have two witnesses, the damage is consistant with him pulling out in front of me, and there is CCTV pointing towards the roundabout from a Funeral Directors about 10 metres away, I'm not worried at all about losing out. laugh

Which car was yours, the car one the inside or outside of the roundabout ?

Thanks Webby!
The picture has me on the inside doing the turning.

I finally resolved this last night with a lengthy chat with my insurers and their investigations department. They ended up phoned the guy who crashed into me and he said he had already come onto the round about and was exiting when I crashed into him on the exit!!! What a lying crook!

The exit cannot fit two cars through it, and the damage would point to me having to fit through a 1 metre gap (doing about 60 mph and him doing about 5mph), have the car rotate 90 degrees in about 1/2 a second, and then colliding with the front of his car, AND THEN both cars SOMEHOW moving backwards onto the roundabout again.
The thick tw*t obviously didn't think about his b*llocks reply, when saying I didn't have my headlights on or I didn't indicate (I did actually have my lights on and did indicate) would have resulted in a 50/50 claim.

The insurance bloke who spoke to him said his voice was shaky and he kept repeating himself and making mistakes on what happened. He 100% knew he was lying, and said I wouldn't have to pay a thing. They were confident enough they would get the claim sorted, and are sending an engineer to assess the damage and the road where it happened. Result! smile

Got a call (or rather, I phoned them, they were 1 week behind - typical Vauxhall customer service), and they said it was a total loss ie. a write-off.
Dunno where I'm going to go from here, whether to buy it back. It's only a frigging scratch on the bumper.
It doesn't get any worse.
Posted By: Pomp Re: Blind, careless driver crashed into me - 4th Sep 2006 8:11pm
If its jst a scratch on the bumper then u may aswel buy it back.

how much is it for it back?

If it aint too much then ye best gettin it back, jst my oppinion... if the cars not in such a bad condition then its worth it i supose dependin on the cost of gettin it back like.

I agree, Escapades. I've even enquired with the insurers about buying back, and Vauxhall said I can pick the car up, although I don't know whether this will mess up my claim. :?

Anyone had experience with this, as I haven't got a clue, and am probably worrying about nothing. wink

just got the email of me sister here's the info..

if the crash isnt their fault they have two options -

1) if they have fully comp cover with own insurance company they can get their own insurers to deal with the claim & they will then - as long as the third parties insurers admit liabilty - recover the outlay incurred from the third party insurers & the No claims bonus will be reinstated once the insurers who paid out have recovered the outlay. It will show as claim but a non fault & no it should not affect

or other option

2) ask the insurers of the at fault person to deal with the not at fault persons claim.

It wont affect a claim if a vehicle is written off no, basically a vehicle is written of if the cost of the vehicle repairs exceeds i think 60% of the value of the vehicle before the accident.

does this answer the question??
Posted By: DavidB Re: Blind, careless driver crashed into me - 9th Sep 2006 1:58pm
I think you're right as that's round about what they said. I get the 'market value' (I'm not expecting much), and to buy back the car, they said they will take 5% off my pay out, and I can have my car back.

The thing is, with it 'written off', can I use it, or will I have to break it? Is it insurable?

I went up today to pick it up, got the train for the first time in years. I arrived (after having to walk about 3 miles) and they said the body shop people have gone home and they didn't have the key. Typical Vauxhall customer service as usual.

There are 4 different categories for write off's. Cat A and Cat B's arent worth repairing at all since the damage is so extensive. C's and D's can be repaired (if the insurance companys thinks its worth it) and can be put back on the road.

By the sounds of it, yours will probably be a cat D since the damage is minor, but because of the car's age, the insurance company dont think its worth repairing.

If you do buy it back and get it repaired yourself, it will be registered as a Cat D write off. The value will drop even more becuase of this.

When my car was deicded to be beyond economical repair, the isnruance company of the party at fault (Norwich Union) let me keep the car anyway.

With regards to a payout, make sure you hold out and dont accept their first offer.

I was offered £525 at first, and Parkers confirmed this was a good price (they valued it at £545), but I let it stew for a few days and then rang up asking what their offer was, they said £525, so I said I had a quote from an independent website who suggested it was nearer the £600 mark, and they paid me £600 lmao!

I read not to accept a first quote in Auto Express, and it usually works from what I have heard.

Still got it now, although its sorned. Good job too, as I may need to swap the engine from it to my current Clio thanks to my stupidity.

smile
