Sounds like you may not have earthed something properly, worth checking the battery connections .

Is it spinning still engaged on the flywheel or free spinning could be the two live wires touching, or it could be sticking on the shaft causing to overspeed.

How do you know the starter is still spinning / engaged?

If a starter sticks like that they generally tend to burn out as the engine revving is more than their intended speed.

Also, how is it draining the battery with the engine tunning - the alternator will run the car with the engine running.... think

cheers for the ideas guys i will check the terminals again but i'm pretty sure they are fine i'v had it on and off about four times now and its spinning freely not engaged wid the flywheel and the battery is dying because i think its getting drained by the starter quicker than the alternator can charge it

Are you sure the key is not sticking?

This will make the starter motor stick on and eventually burn out.
