Nope, in the eyes of the law she has no licence.

Maybe - is the answer

She does still HAVE a licence because it was only being sent away for photo renew BUT it would have been wise to take a photocopy of the old licence and the completed form as sent to DVLA. That is what I did last week

If she does not have either the letter from DVLA saying the licence needs renewing or a photocopy of what has been sent away then it will of course be difficult should she have a reason to show her licence to some authority eg police.

According to the DVLA website:

Driving before your licence is returned

You can drive before you get your licence as long as you:
•have held a Great Britain or Northern Ireland licence issued since 1 January 1976 or another exchangeable licence
•are not disqualified from driving
•haven't been refused a licence for medical reasons or for failing to comply with medical enquiries
•wouldn't be refused a licence for medical reasons - if in doubt, check with your doctor
•keep to any special conditions that apply to your licence

the one thing they don't say there is the licence has to have been processed so until the dvla confirm that it has she can't drive as until it's been processed (not just received) by them she does not have 'a current valid' driving licence.

Go on dvla website and renew it on there. If she got a passport she can give her passport number and they can download that pic for her. its easy and quick

I'd really get a new one sorted before driving, I had my car seized because there was a simple 6 year old discrepancy on mine, and the copper was very pleased for an excuse to put it in the Gulag. Don't give them any reason to do it. smile

Hi all thanks again for the replies, the licence has now been sorted, well sent off and i copied all the docs before sending.

Just before i did that i popped in the old cop shop, and asked the same Q,can she legally drive.....

Er dunno mate, theres so many rules on it,yes says i but what if she gets pulled over by traffic plod.

Er best thing to do is phone DVLA as soon as.

And with that i left smack
