I bought a car from a auction which said it had WARRENTED mileage which means its genuine (i also asked this before i bought the car). The mileage was 40,000 at the time.

I did a HPi on the car found out that the mileage was lowered.

The car MOT says that it did 30,004 mile in 2011, 35,986 in 2012 and 3954, in 2013. The auction uses this to see if its genuine and warranted.

I got a HPi report and on the report said that it did 35,453 in 09 DEC 2009. This was reported by the BVRLA

And also on 2008 it was lowered from 19,512 (recorded by trade association) to 18,000 (recorded by NMR)

I went to the auction regarding this and they said they wound not give me a refund or even a partial refund. I tried speaking to the manager about this but he tries to avoid me (rang them and he picked up phone then passed to a woman saying he's not there and also walked away when he saw me walk in to to the office of the auction.) And now they tell to go away and are 'fed up' despite only visiting and calling them once.

Where would i stand on this as I've tried selling it but everyone backs out because of the mileage discrepancy.

Any help would be appreciated

so what mileage are you saying its done ?
The figures on the MOT are the clock figures and not what its done in a year.

they figures you have listed don't see to be much different than whats listed.

Also why would someone bother to clock a car to just take 1500 miles off ? Can't see it happening for the value it would add to the car (virtually nothing)

Could you go into more detail? I'm curious.

It's currently done 40,100. And I don't think they've clocked it 1500 miles as the BVRLA company recorded it done 35,453 on December 2009 while the MOT recorded it done this mileage in 2012 June (35,986). This shows that is has definitely been lowered a lot as its recording the same-ish mile for 2 years

Could it not just have been stood off road or in storage?

Its not like the mileage has gone down from a previous recording.

Okay, let me see if I've got this right:


2008 - 19,512 lowered to 18,000
2009 - 35,453
2010 - No Record
2011 - 30,004
2012 - 35,986
2013 - 3954 (guessing you've missed a digit off, input error ?)
2013 - 40,000

When you look at it like that, the car has averaged 5,000p/a

If the 2009 figure was 25k rather than 35k everything would look right. To me it's just been an input error (see above, they do happen) they've pressed 3 rather than 2.

The alternative is that in one year they did 15k, rolled the clock back for the next then did a constant 5k for the next 3 years, doesn't seem likely.

The auctioneer has a duty to give correct information.

If the car had "warranted mileage" in the catalogue then you can only treat that as an "indication", the contract is what he actually says on the podium, so if you REALLY want to push it you'd need a copy of that (it's recorded), but you will have to pay for it.
