But where driving falls far short of what is safe, prosecutors can press charges of dangerous driving.

When he announced the change in policy earlier this year, Director of Public Prosecutions Sir Ken Macdonald said such cases could include sending a text message while driving.

The Crown Prosecution Service says there are no plans to change the guidance on the prosecution of drivers caught using their mobile phones in Scotland.

You know something it makes me sick that the goverment has enforced this.. Why dont they fu**in lock up theives or pedos or something and not people who are trying to work on the move.. Most drivers use bluetooth and the such i dont see the problem.. Dont the goverment realise that some of us can actually multitask and are quite good at it.. I say yer to a fine if someone is holding a hand set to there ear while driving that is the obviously stupid that do that. But if your using a bluetooth headset and watching the road and speaking i dont see any issue with that.. the goverment are stupid and need to wake up and tackle real crime for christs sake....

Also as well.. We can speak to passengers in the car and thats even more distracting.. smile Ohh it gets up my nose.. Its alright for the Police to speak in a fu**in radio while chasing some joyrider.. So whats the difference ?

If i heard it right, its been upgraded from

"Carless Driving"

To

"Dangerous Driving"

So the max offence for Dangerous driving is 2 years.

Each case is on its own merrits.

But for example, a Lorry Driver Ploughs into a Car
as the driver of the lorry was distracted on his phone
then he can get done for Death by Dangerous Driving
and not "Careless Driving". And because that would be
so sever the accident then the 2 years could be enforced.

I may be wrong with what i think it is,
but you will only be in trouble if because you were on
your mobile at the time you were no longer safe?
Head set or not.

So you can still use your Head Sets to drive.
And use the phone but if you cause an accident because
you were on the phone then be prepared to be slammed
with "Dangerous Driving" On your licence too.

That's my understanding of it anyways.

After seeing numerous accidents caused by people using their mobiles phones whilst driving on tv programs, including a horrific one involving a large van crushing a 206 into less then a metre and instantly killing the woman driver, because the driver was scrolling through his phonebook instead of having his eyes on the road, the more deterrent they put in place for driving whilst using mobiles the better.

I always pull over when possible, and if its not possible and I dont have my handsfree kit, I just leave it and wait until it is possible and ring the person back.

I dont see what everyones problem is, either use a handsfree kit or pull over in a safe place when using the mobile. Its not rocket science.

Some cars can do 150mph as safe as other cars can do 70, and brake in half the distance of a normal car at twice the speed.... so does that mean the NSL for motorways and dual carriageways should be increased to 150mph?

Just because some people can multitask and multitask well doesnt mean everyone can.

And it doesnt matter if you are good at mutitasking, when you are using your phone, you will never have full concentration on the roads, the split seconds you are reading a text, looking for a number, answering the phone can make all the difference between you hitting a child and seeing that child run out onto the road in just enough time to break.

And technically, the human brain cannot multitask at all, it only has one thread for thinking, you cant think of two things at once, its one thought at a time. Which will ineveitably delay your reactions on the road if you are busy doing other things.

wink

I hate people using phones when theyre driving.

I always pull over to answer my phone.

Its a bit harsh for getting a Dangerous Driving offence if you have one of these phone systems which uses your car stereo though, as in my eyes, it is the equivalent of chatting to a passenger.

I tried to answer a call the other day whilst driving just to say I was driving and couldnt talk... didnt feel safe, so I left it till I could pull over... took me eye off the road for a second whilst I looked to see who it was, and yeah in that space of time, summit could quite easily have happened.

Also, sometimes I hate having passengers in the car as you have to think about what you are talking about sometimes and it deffo does mean less concentration... I tend to blabah on about nothing in my replies because my concentration is on the road rather then the convo lol.
