hmmm think
yesterday i fixed a car for someone, whilst test driving it i then pulled over at the kerb with engine running,a couple of mins later a little yellow police van pulled up and asked me to get out.
they asked whos car it was cos it was insured to a lady, i told them what went on prooved i was insured etc then they checked the car.
I got a lot of crap off them in the meantime due to me having assault police on my record...
"well well, wouldn`t you know" a bald tyre.
i recieved a £60 fine and 3 points
They didn`t actually see me driving this said vehicle.
1: am i still eligible for these points
2: i was told the fine should of been £30
Can anyone help me to resolve these answers?
Thanks
Ste smile

It may come down to the same as drunk and in charge?
If you have the keys and your in the car you can
be done for drunk and in charge of a vehicle.
Even if your sleeping it off.

Strange as i was watching a kops tv thing only the other
night, they pulled over a BMW with young lads in it,
for what ever reason, and he gave him a horty (Producer).

He was told that he would have 7 days to show that the
bauld tyre on his car was fixed / replaced.
There was wire coming from it.

Another Ploice Power Trip by the sounds of it.

They can execise any rights they want.
So what you have must be the top end of the scale?

Apart from that im not sure what you can expect?

Even tho they never seen you driving the vehicle but the engine was running you are still the driver. As soon as you turn the ignition an ur sittin in the drivers seat you become the driver of that car as the cars running.

Say you was sitting on the drivers seat but the engine wasnt turned on then you are still a passenger.

Unfortunatly I think they dont really need to see you drive the car if you have already had to prove you are insured to drive it to where it was when they pulled up smack

3pts and £60 is the going rate for a dodgy tyre, and the driver is responsible for the condition of the vehicle, very unlucky is that frown

Nothing can be done about the 3pts, but maybe the owner of the car can sort you out the fine.....?
