New parking laws are due to come into force at the end of March, and consumer group Which? says they could make it more difficult to appeal an unfair ticket.

The new laws are designed to introduce a fairer system of charges, with lower fines for motorists who exceed their time limit in allocated parking spaces, and higher ones for those who park where parking is always forbidden. Clamping will also be discouraged.

However, it's the way in which offenders can now be caught which could leave the driver disadvantaged. Councils will be able to issue a parking ticket by post if they catch a motorist parking illegally on CCTV.

This could make it harder for motorists to gather evidence if they want to appeal against the ticket if they feel it has been unfairly issued.

The advice is to act quickly, put your appeal in writing, and gather as much evidence as you can for the best chance of success.

how do you gather evidence, or more like, why would you gather evidence if you didn't know you had been issued with a fine. and by the time the fine arrives via post, the evidence would be gone.

Yep. Seem's pretty simple to me. Don't see why so many people have a problem with it.

I dont agree with the places they charge people to park in the likes of Birkenhead... but parking there and not paying, and ending up with a fine, isnt going to change that.

If anyone watched "Watch Dog" last week
they were highlighting hope private parking
firms were exploiting the use of CCTV.

Even when someone was doing a drop off out side
a station they were getting a ticket.
Because the Photo used was a still....

This only applies to private parking enforcement
who apparently have no rights what so ever to charge you.
And the invoice for paying the fine isnt a legal document either.
Something like that any ways.

So if private firms are exploiting this, then its fair to
say that councils could also exploit it too.

Yes... but this has nothing to do with private firms.

And you know as well as everyone, 99.9% of tickets are given out for people parking illegally... Regardless of whether they should be able to park there free or not, why should some people think they dont have to pay/park on double yellow's/resticted area's etc and get away with it?

Again, it comes down the usual moral... dont do the crime if you can do the time (the time in this case being a fine).

In the case of a council penalty being levied, if you believe it is incorrect, there is also multiple way's to appeal against the fine's, which there isnt with private companies.
