I came home today to find i had a letter off my insurance.
ITS WITH TESCO.

This is what they have said.

In regards to your motor insurance policy we are exercising our right to cancel your motor insurance policy from 12th August 2005 as per condition 5 (a) of the lopicy wording.

This is what the policy says.

Cancelled by our sending 7 days written notice to YOU at the address last known to US and in the event WE will return the premium less the proportionate part corresponding to the period the POLICY has been in force.

The effective cerificate of motor insurance remains our property and must be returned in accordance with the traffic acts.

I havnt been banned got points or not payed my insurance. Also i took this policy out back in sept lastyear so its also my last payment.

When i took out the policy a lad a know told me tesco have a habit os messing you about and canceling peoples insurance.

Any help on this would be most greatfull.

Right been on the phone 2day and hears what got said.

I was told the case was a csd matter whats that then.

Also told that a report had been made about me driving dangeres or somthing.

If you are not charged and convicted how can you be guilty doh

I have 2 friends in the legal sector and they are looking into it.

Told me i am insured till midnight friday (car maybe stolen by then raftl ) only joking.
And to take out new insurance with a different firm then take matters further because it has not been made clear on why this has happened (in the letter) and also wasnt given 7 days and that i have not been charged for anything so what tesco's my have done is broken there own contract.

But knowing big firms they will have a wayout.

Will know more 2mora.

Didnt you get pulled off the rozza's recently and given a section 59 or somit like that ??

Just thinking why they have cancelled it. Dangerous driving and section 59 are similar things but not the same.

Scratching about for the connection.

Was thinking that myself but why would the feds tell my insurance.

Just got a quote from sainsburys and its £883 if i dont keep my no claims were as tesco's were £1241 so getting rid of tesco's anyway i look at it.

If i keep my no claims it will be £541.

Who knows some good my come out of this yet.

The rozzas are possibly notifying insurance companies after issuing a Section 59 in an attempt to stop people driving mad or gathering in a public place ??

If it cancels your insurance your going to think twice about getting another section 59 wont it smack

It makes sence to me but i really disagree with it......

I do agree but whats stopping the police giving you a section 59 for doing 35mph in a 30mph they can play with your life that way cos i bet if i wasnt with the peps from the cruise it would just a telling off like my 90mph down the back of camel lairds not so long ago. (they neverhad a speed gun by the way and it was in the bm)

This whole issue has been causing me allot of concern as it can effect all members of the crusing community so i have set the Cruisewirral detective to work and the reply is not good.

As suspected Tupac's insurance has been cancelled because he recently recieved a Section 59 from merseyside police who in turn notified Tesco's Insurance and therefore they have cancelled his insurance

This information is 100% accurate it come from the horses mouth so to speak think

Seizure of vehicles (Sections 59 and 60)
44. Section 59 gives the police new powers to deal with the anti-social use of motor
vehicles on public roads or off-road. It includes powers to stop and to seize and to
remove motor vehicles where they are being driven off-road contrary to section 34 of
the Road Traffic Act 1988 or on the public road or other public place without due care
and attention or reasonable consideration for other road users, contrary to section 3 of
the 1988 Act. Section 60 allows the Secretary of State to make regulations relating to
the removal, retention, release or disposal of motor vehicles seized in accordance with
section 59.

Ref: Policy No: P60033
20 August 2004 Ratified by FMB 12/8/04/ 10.4
Ref: Policy P60033
1 Background
1.1 The provisions of Section 59 of the Police Reform Act 2002 commenced on
1st January 2003 and provide uniformed police officers and designated
Police Community Support Officers with powers to deal with persons using
mechanically propelled vehicles in an anti-social manner, either on or off
road.
1.2 For the powers to be available, the officer must have reasonable grounds for
believing that a mechanically propelled vehicle is being used on any occasion
in a manner which:
Contravenes section 3 or section 34 of the Road Traffic Act 1988
(careless and inconsiderate driving and prohibition of off-road driving),
AND
Is causing, or is likely to cause, alarm, distress or annoyance to members
of the public.
1.3 The officer will also have these powers where he/she has reasonable
grounds for believing that a motor vehicle has been used on an occasion in
any manner falling within paragraph 1.2 of the Policy.
1.4 If the mechanically propelled vehicle is moving, a uniformed police officer or
Police Community Support Officer (‘PCSO’) can order the person driving it to
stop.
1.5 A uniformed police officer or PCSO may seize and remove the vehicle by
authorising towing by a Hertfordshire Constabulary Authorised Recovery
Agent PROVIDED he/she has warned (see 2 below) the person who appears
to be using it, that he/she will seize it if that use continues or is repeated and
it appears to him/her that the use has continued or been repeated after the
warning.
1.6 For the purpose of exercising a power under 1.2 above, a uniformed police
officer may enter any premises, other than a private dwelling house, on
which he/she has reasonable grounds for believing the vehicle to be. A
PCSO has the same power except that he/she can only enter premises when
in the company, and under the supervision of a constable. Note: A private
dwelling house does not include any garage or other structure occupied with
the dwelling house, or any land relating to it.
1.7 Reasonable force may be used, if necessary, in the exercise of any of these
powers.

It is therefore vital that officers verify with the driver who the owner of
vehicle is at the time of issuing the warning, so that a copy of the notice
can be served on them.
In the event of any litigation by the owner, Legal Services Department will
deal with this issue.
In the event of any prosecutions under Sections 3 or 34 of the Road Traffic
Act 1988, the Crown Prosecution Service must be informed as part of the
disclosure of evidence whether a warning, seizure or disposal of a vehicle has
taken place.
