This is a topic for discussion and hopefully I can get some important information that will help the situation.

A few months ago my father was driving along a M6 in his new shape Vectra. He was coming home from being down south working. He was in the middle lane sticking to speed limits etc (He's been driving for like 30 + years so hes a sensible driver, no license = no job). A rover is in the outside lane and pulls into the middle clipping my dads drivers rear quarter panel, spins my dad 360 (At national speed limit in rush hour) and he manages to control it and get onto the hard shoulder.

The rover is being driven by a young 'muslim' girl, her car is a wreck. 1 witness pulled over onto the hard shoulder aswell. The highway police come and sort everything out, my dad didnt appear injured and he didnt want to spend hours being towed home, the police checked his car and said it was road worthy to drive home, so he did.

Next day my dads got bad back pain (I know hes over middle aged but hes never had any back pain previous), so he goes to the hospital and they put him on tagblets to cope with the pain. His car gets taken away to be repaired and he gets a courtesy car in the mean time. We contact RMNJ (A reputable solicitors), inform them of the inncident and they accept my dads claim (Personal injury and the damage caused to the car that my dads company will have to pay).

The whole process was going well, on my dads side anyway.At the time of the accident the police passed on the drivers details to my dad, but it now seems her name has changed now its going through solicitors (Hasnt changed much, making us believe she may be pretending to be her mum etc). Ofcourse she claims it was my dads fault.

Heres were it changes: A second witness has now claimed to have been 20 meters behind my dad and seen it all (Even tho its rush hour and there were several lorries behind my dad), he also says it was a blue car (My dads is blatent black). This new 'witness' also lives local-ish to the girl driver, and is also a muslim - There is no evidence he was even at the scene of the accident. He was avoiding the solicitors...not responding to letters...ignoring the phone or pretending it wasnt him etc

The 1 witness that was there told my dad at the time that he seen it all and that it was the girls fault. Since my dad was pretty shaken up he never got out his car, he allowed the police to do there job and quite frankly wanted to come home asap.

The highway agency failed to get the witness's details so he could not be contacted. As a result the claim was rejected on grounds of there was not enough evidence.

Would I be right in saying it was the polices job to get the witness details? What if my dad was taken away in an abulance, he couldnt get them himself and as a result the claim has been stopped.

Could my dad sue the highway agency?

Any more ideas?

[Note: RMNJ done everything they could, and we couldnt fault there service at all]

in a way yes you could sue as they clearly ain't done there job properley.

has the car been fixed now? who paid?

The company paid for the repair months ago, its all sorted.

Just an annoyence that my dad keeps getting back pains from some stupid b!tch not paying attention.

Do you have anywhere I could perhaps look to strength this?

brian camp and do a personal claim, do the "back to painful to sleep" "can't walk my dog or play tennis" routine, they will get intouch with the second party through her car insurance.


will give me sis a ring and ask her as she works in insurance and see what else you could do.

The problem was, my dads witness cannot be contacted so it cant go any further.

We think that this young girl has said to someone she knows 'Become my witness and ill give you £500' <-- She wont be bothed because if she wins she gets her car paid for any any injuries.

Lets not bring race into this,it doesnt matter that shes muslim,and her muslim friend is helping her. she could be white,and have a chinese friend help her, the fact is,shes got some1 lying for her,and the police HAVE ****ed up.u may be able to sue the police for not gathering the evidence,im surprised they havent chased her up and charged her with dangerous driving (nearly always happens when police get involved,got to justify theyre presence with a conviction)

Without hard evidence ur pretty ****ed when it comes to winning the "whos fault was the crash" claim,but u HAVE the hard evidence that the police never gathered evidence, do u have info and or correspondance from the police/highway guys. and does any of the "muslims" corespondance imply the accident was HER fault,what was her description of the accident?

The police havnt been involved in the case at all/very little if they have.

Her statement implies it was my dads fault. Her witness's implies it was my dads fault, but the statement was changed once at least, plus some of the facts are incorrect.

Its basicly 2 against 1 - If the police had done there job we would have won the case. When my dads witness was present he went to see if my dad was ok, and in convosation he was certain it was not my dads fault.

put a advert in the local paper calling for witnesses either that or get some1 you can trust to be a made up witness, it happens all the time. In court its just aload of b..sh.t anyway, who eva has the best story wins lol. Contact the police to find out if they managed to get the details of her witnessess if not your possibly right. Bet you her witnesses are all muslims ha ha ha ha. I take it to courts myself if so just to see the judges face muslim driver and all muslim witnesses bit of a coinsidence.

She's partly admitting that it WAS her fault, because if it was your dads fault she would want to sue your dad. Unless she is sueing?

I think the point Dazza is getting across is that the Muslim witness is from the same community and NOT race orientated.

The police should have identified the people involved with the correct ID. That way the ID could be corresponded to the Driver (Or Mother), Secondly the police should have gathered the identity of the witness.

Shurly the police in attendance should have made notebook entries of the people involved ? Maybe request a copy of the notebook entries ?

I am sure i was driving on the same road on the same day and seen an accident with a black car, could i possibly be a white male witness ???? think
