hi all, looking for advice, i made an injury at work claim against my employer (large company)they admitted liability on 15/11/12, i accepted there compensation offer,i signed and returned acceptance form to my solicitor the same day, on 31/01/13 i contacted my solicitor only to be told the cheque from my employer to my solicitor had been "lost in the post" he had asked for a new cheque to be issued. on 12/2/13 i contacted solicitor again, still no cheque, he said he would chase it up, on 25/2/13 contacted solicitor yet again, stating i was loosing interest on the monies owed, he then informed me he had agreed a settlement £300 higher (i was told 3 months after i had accepted offer)
What i would like to know is,
1- is there any way of finding out what the real offer is after 2 different amounts i am beginning to doubt my solicitor as to the settlement offer, could it be higher still ??

2- has the offer got to be paid to me within a time limit, IE- 30, 60, 120, days, i would be grateful for any ideas.

if you are in a union contact your union head office, or contact Citizens advice bureau Price street Birkenhead.Call in there any morning and they will give initial advice and make an appointment with someone who specialises in your type of query

My first advice would be to look at the paperwork you got in your initial response pack which would have told you your Solicitor/Legal Rep's obligations to you & a guide to how the claim will proceed. You can ask for clarification of the amount agreed, what date & what they intend to do RE: chasing the payment.

As a rule (for PI claims), we used to request that the Defendant provides the damages cheque within 14 days of an offer being accepted. Unfortunately, insurance companies in particular can be very slow and in terms of the cheque it is a case of keep chasing them up until the cheque is received. Some insurance companies are worse than others!

Is it a local Solicitor or a generic firm for PI claims?

Hi Wench, its a liverpool based solicitor, just asking about the £300 extra that appeared out of the blue, but only when i mentioned i was loosing interest, started alarm bells..

It may have been for physio if it was suggested in your medical report (if you had a medical) or for any out of pocket expenses you may have incurred. Best way to find out is to call them and ask - don't be fobbed off by a junior either. Ask to speak to the Solicitor in charge of your claim. They will document how long they speak to you for & claim for that time anyway so it's no skin off their nose wink

solicitors are not always honest, chase your money, do not be fobbed off.

we have sort of similar problem, altho ours was for car accident.....other side insurers insisted on going to court, this was 4 weeks ago now, judge found in our favour and ordered monies to be paid in full within 21 days....how can we get hold of a copy of what the judge said so we can issue proceedings against them?
