Here is some advice for any one thinking of taking a Contract out with Three, Please do not, unless you are ready for fights with them, as they say the consumer credit act does not apply to them, they say they have there own policy.

I went in to the Three store in Birkenhead, I was not happy with there terms, and went into cancel contract as it was only 2 days since i took out contract, I took in the relevent print outs from Consumer credit act Ref Contracts, they said "consumer credit act does not apply to them, they say they have there own policy" and that policy is " you take out contract you are stuck with it and you pay"

I tried to explain to them they have to let me cancel, they then called security and called the police saying to police I was refusing to leave the store "this is not true, as at no time did they ask me to leave the store, the police came and the lies the staff came out with in there and the manager, I could not believe what i was hearing, "it was the manager who was verbally abusive to me" but of course she denied it.

Please think twice about getting a contract with three.

i even phoned up call centre and asked to speak to manager, they tell me they have no managers, and to just pay for device, and hung up on me.

I have emailed there CEO & Executive office, but I have been ignored.

I can not even cancel direct debit as it has not been set up yet.

I am now left with no option but to sell the ipad and just buy out of contract.

Oh no that is terrible customer service!! Sounds like they are just blagging you, go on watchdogs website and see if they can do anything? you can actually e-mail your problem to them, sometimes these companies just try it on and if you push it further they usually give in, aww I hope you get it sorted keep us posted.

They are horrible people, I got roped into a contract in 2004 via a cold call from a company not 3, £15 12months with £5 insurance a month, after 3 months it went to £30, couple of months after that £50, they also kept adding extras without my knowledge or consent like tv channels and billing me extra for them.

With two months left on my contract the pins on the phones charging port snapped though general wear and tear, I called the insurance and they wouldn't fix it, wouldn't even look at it so I cancelled my insurance and waited out the last two months counting the days.

The day my contract was up I called 3 to inform them I no longer wished to carry on with the phone and got through to india I know this cos the guy was more interested in telling me the weather in Bombay, It was raining, he point blank refused to listen to me so I told him as far as I was concerned that was my notice of termination, the contract was up and cancelled and I would not pay them any more money, they proceeded to send two over priced bills and then their finest bulldogs calling me to say no sorry shout if I didn't pay them right then bailiffs would come to my house and take the money or my stuff that day, being my first run in with debt that was scary, every day I got this even despite telling them that it was in dispute, then the debt collectors came in when I stopped answering to 3's numbers.

The debt collectors where relentless even calling Christmas day! I proved to three of them that there was no debt by calling the company I took the contract out with to send what they had on it to the debt collectors but by the forth the company had gone bust so I called the first debt collector to help and got rid of the forth.

The fifth debt collector was breaking point calling me every 10 minutes for an hour, 5 hours a day, so I did some research called 3 and told them that as the company was hired by them they are responsible for the actions taken and where breaking act such and such and to call them off or I will sue, they wouldn't let me talk to a manager and they hung up.

Those collectors stopped and I moved house, twice, the second time before I'd even moved my stuff in there was a letter from a sixth debt collector! I ignored them and eventually the letters seemed to stop and then I moved again so I don't know if they have given up.

That was this year they have been chasing me for a debt I don't owe since 2005, 7 years!

I have learnt a lesson here, (never deal with Three) its my own fault for not listening to all the reviews about them on the net, I will sell ipad and put extra to it and just buy out of contract.

Lesson learnt.

Where did you sign up for the contract (store? internet? phone?), and what part of the CCA are you trying use?

New rights under the Consumer Credit Directive

Under the Consumer Credit Directive, which came in to force in Feb 2011 consumers now have 14 days to cancel a credit agreement. The legislation applies to all credit agreements, whether made in person, on the internet or over the phone, under changes to the Consumer Credit Act 1974.

Been to bank, nothing they can do, I can not do a charge back, as it is under £100 upfront payment that i made.

Have sent email to trading standards.

I am left with only 2 options.

A: Find some one who is going to take out a contract for the ipad, but who does not want to pay upfront fee, but is prepered to take over this contract, saving them selves £99

B: Sell ipad and put extra to it and buy out of contract.

If i get to do (A) then I will have to find a translator who can translate what there call centre is saying.

Dont know if a contract would be classed as credit as youre technically not borrowing any money youre paying a contract fee.

Except a mobile contract is a service agreement, not a credit agreement. As far as I know, there is no longer a cooling off period for service agreements.

However, if the serivce can't be provided, or isn't being provided, you can cancel. As Three's coverage on the Wirral is sporadic at best, I'd suggest you find what the HSDPA/HSDPA+ coverage is like where you live, work and visit regularly to see if you can get out that way wink

3 are a nightmare i took out a contract 6 years ago with them and 3 months into it i lost my signal,when i complained they informed me they were in the process of putting new masts in my area but meanwhile i was paying for a phone that was unusable,they refused to cancel my contract so i refused to pay ,they have chased ,e for 6 years and each debt company they send it to cancel it after i explain and from january due to the statute bar law the debt will be wiped ,it never showed as a black mark on my credit rating either due to no debt firm aver thinking they could make a judgement against it.

Been with them for about a year now and never had any problems, everytime I have had to ring them they have helped sort what I needed right away with no problems.
