Loads of us had our rooms in the Nurses Home broken into when we were all on a night out. That was bad enough frown At that time, everything I owned was in that room. I bleached everywhere they may have touched. The whole corridor reeked of bleach and disinfectant for weeks. The worst thing was, it didn't take much to get into the rooms as we all knew that if we locked ourselves out of our rooms, all we needed was an empty coke bottle (or other plastic pop bottle) cut and folded, and you just had to slide it down the gap in the door and flick the locks.

They introduced a card system to get into the building after that, but all it took was someone to say they were xxxxx's new boyfriend and someone would let them in. Had a psych patient go on a rampage in there one night after gaining entry that way.

We took it for granted that we'd be safe on hospital property. How wrong we were frown

Now think about this, a Criminal breaks into someones house with no other intention then to obtain a laptop he can see thats been left out. He forces open a window, gains entry and begins to collect the item he has spotted. He is then confronted by the home owner whom he has disturbed. The home owner then proceeds to use violence against him. Does the Criminal not have a right to defend himself against the home owner under the above?

The Criminal dies due to injuries sustained from the home owners actions. The home owner must stand in front of a court and plead his case of Protection of his home, his property and above all his family. The Criminal in no way offerd violence to the home owner.

So the home owner can not use self defence as a reason to act. The Criminal did not have a knife or other bladed/pointed article about his person so the use of lethal force against the Criminal was not sanctioned. Assuming he could have a knife 'cause thats what kids do these days' is not a defence under law unless he pulled out a knife and threatened to use it thus confirming he had one so you would be able to justify the use of force. But in this scenario he didnt pull out a knife so therefore did not have one. But if he also had a knife on him but it stayed in his sock the whole time would that still be enough for him to claim self defence? How can the home owner claim self defence against somthing he didnt know excisted??

In response to the first comment on this thread and like many others what if you did catch someone in your garden and they then run off down the road. This is them trying to escape not confronting you, You catch upto them and then what? You trip them up, place them onto the floor and sit on them waiting for the Police to arrive? Ok fair enough. How about you push him to the floor and give him a sly kick while hes down, He then fights back to help himself escape from the situtaion and the present danger against him. Who was in the wrong? The 'criminal' has ran off and poses no danger or threat against you therefore can you act against him?

Now im not saying you cant act against him, im just saying does it always have to involve the threats of violence you are all quick to type in your keyboard warrior mannor. It just strikes me that some people on here type without realising the consequences of what you are saying.

All the above is just said for guidance and should never be acted upon or referred to, Its all based on a made up pretend scenario for example purposes. Anyway just trying to paint a bit more of that big picture that everyone these days seems to look at and ignore or just not look at in the slightest! smile

Well well well, it seems everything you have said is correct, kind of brings the "think before you act" scenario to the brain within 2 seconds of reading it, that tells me your either a police officer, law student, barrister or parole officer?

Personally, having been burgled quite a few years back, I know what it feels like.
If anyone tries breaking in here whilst I'm in and I catch them I'll beat ten kinds of shite out of them, see, thing is, that ... will take the blame for the last burglary, my car mirror being broken, scratches on my car, my dog being stolen, the idiot that cut me up etc etc, everything that's happened to do with scumbag asshole smack rats shall be laden upon the would be thief.
Maybe they'd kick my ass? But hey! You don't think about that at the time, they're gonna be more interested in escaping than sticking around beating the shite out of you anyway.

Consequences? I don't give a crap, I catch em? I'll beat them within an inch of their lives and I say that proudly.

I for one am sick of the ... and the way society has become in the "modern age". People need to sort this ... out and maybe they will think twice before they attempt it in the future.
I'm pretty sure it's not just me who thinks this either.

I think the law has got it`s hands tied and when the police finally get`s the scumbag`s in court with all the evidence stacked against the ..., they are then met with the do gooder`s who get them off normally with a ticking off or some thing harsh (lol) like that ,vicious cicle if you ask me ,idealy the police should find them bring them back to the people they bothered and let the victims deal with them ,lesson`s learn`t but that won`t happen

well said ste, im with you on that mate, kick 10 kinds of shit out of them, its not just replacing items they steal, its the mental issue, if you have kids, they will be scared going to bed, and you will be on edge for months, trusting no1 busted

Ste, sorry to hear about what happened, hope that it doesnt affect you too much and that the ... (no other word for it) get their just desserts one way or another.

I am totally with you on your point. I know the self defense/equal force argument that some try, but tbh, if someone were to try it on I would do the same thing.

Its easy for the PC brigade to say 'oooh thats naughty', but my point would be, you have no idea of peoples intent. They might not be there to burgle, their purpose could be a lot more sinister (kidnap/rape/murder/etc). They do not break into your house and hand you an itinerary of what they plan to do.

It might seem a little extreme, but it does happen and there are some crazy people out there. You never know if your house will end up being the unlucky one.

I will do anything to protect my family and on that, I will defend my family. I would go at them with anything to hand regardless of if they went for me or not or had a visible weapon or not, damn the consequences. Slightly altering an above post, better to be judged by 12, than someone you love be carried by 6.

The PC brigade can do their 'well if they didnt have a weapon, blah, blah', but I honestly am of the opinion that you enter someones house, you lose any rights and risk your life. Yes that is an opinion, not law, but at the time, they are willing to break the law by entering my house so the law is irrelevant to them, so its definitely going to be for me when its comes to going for them.

Don't get me wrong, what I say may seem harsh and wrong or maybe OTT, and I am no means a fighter/warrior/whatever, I dont carry baseball bats around the house, etc. I dont even know how effective I would be, but that does not mean I would not try my best to protect those I love, to me that means attacking the threat until it ceases to become a threat. That is how I feel.

I dont think I am the only one.

Off rant, again Ste, sorry to hear this happened.

I agree with rhoobarb, if someone wants to break into your house to steal your things then it's their own fault if they get beat up/killed, they take that risk by doing it. Not to say I'd beat anyone up if they broke into my house, I'd just cry, haha.

It's not just them taking things but you'd be scared to be in your own house, wouldn't sleep, paranoid of every noise etc. If they think it's okay to do that then maybe having some sense knocked into them is what they need!

Well having been to look at my bike a few weeks ago, the little buggers came back on Sunday night and stole it despite me adding extra security and locks they worked their way through them moved the other bikes out of the way and stole mine. Happened in the early hours I didnt hear them and the dog musnt have either. I have spent Monday fortifying the back yard and shed spending quite a bit of money on even extra security.
Please let me know if you see anyone selling cheap bikes in particular a Giant Teraggo 21" frame I have already asked around the area and let it be known what will happen if i ID the culprit.
As a matter of interest, I have fitted a state of the art cctv system around the house; should I record images of further thefts what are the legalities of placing these pics on websites and forums such as this one?
