#287683 - 29th Jan 2009 2:27pm Student wins Rhys libel damages

A newspaper has paid "substantial" damages to a student after it alleged she had called Rhys Jones' killer a hero during a TV interview.

Kelly Marshall, 18, from Liverpool, launched a libel claim after the Daily Star also wrongly accused her of being a member of the Croxteth Crew gang.

Her solicitor said the money would go to the Rhys Jones Memorial Trust.

Mercer was jailed for life for shooting Rhys in August 2007 as the 11-year-old walked home from football practice.

The 18-year-old was sentenced on 16 December, and two days later, the Daily Star published a front page story claiming Miss Marshall was Mercer's girlfriend and she had hailed him a hero.

The paper, owned by Express Newspapers, also alleged she had declared a pledge of loyalty to the Croxteth Crew gang, of which Mercer was a leading member.

'Appalling murder'

Miss Marshall's solicitor, Helen Morris, told Mr Justice Eady at London's High Court that the student had been "very distressed" by the article, which appeared in print and on the newspaper's website.

"The truth is, contrary to the article, the claimant did not make any public statement following the conviction of Sean Mercer," she said.

"The claimant does not regard Mercer as a hero and would certainly never have made such a claim or sought publicity for it, in the aftermath of his conviction for such an appalling murder.

"The claimant is not and has never been a member of the Croxteth crew or any other gang. She has also never been Sean Mercer's girlfriend."

Counsel for Express Newspapers, Kate Wilson, said the company accepted the allegations were false and offered its "sincere apologies" to Miss Marshall.

It will also publish a summary of the court statement in the Daily Star.

Miss Marshall was not in court to hear the settlement statement.

That's interesting, considering the faux moral outrage displayed on this board when this unbelivable story was first published.

1. Evil person. Check
2. Tragic situation. Check
3. Moral outrage. Check

Well all the signs were there.

I wonder if the paper has ID'd the wrong person, as Im sure I saw a video clip somewhere of Seans girlfriend and she was showing 100% support for him.....

I think the link may have even been on this forum think

IIRC they based this article on the transcripts of a SKY News interview, bulked it out with soundbites from outraged locals reaction to their story. Basically they decided to jazz it up it a little for their readership.

Quote:
EVIL Sean Mercer’s gobby girlfriend has been bombarded with death threats after hailing Rhys Jones’s killer a “hero”.

Kelly Marshall is in hiding in fear for her life after her sick “tribute” outraged her council estate.

Now the 17-year-old wannabe model is pleading with Mercer’s former Croxteth Crew gang pals to protect her.

Mercer, 18, was caged for a minimum 22 years for gunning down 11-year-old Everton fan Rhys as he walked home from football practice in August last year.

But Marshall claimed he was “a lovely lad and a hero” and praised the way he had not “grassed” on anyone.

Yesterday, after her senseless rant had been exposed, Marshall fled her usual haunts on Liverpool’s Croxteth estate telling one neighbour: “I need to keep my head down until all this s**t goes away.

“I don’t know what I said wrong but it’s all kicking off and I’m f***ing scared.”

Last night Marshall was warned to stay well away from the area.

Croxteth local David Brooke, 17, said: “She went out with Mercer before he killed Rhys, elbowed him, then got back together with him after the murder.

“She is out of her head with what she says.

“She thought that she was so clever standing up for him and earning respect for the Crew, but she has screwed herself big style.”

Another youth, 19, said: “I’ve heard she is scared s**tless she’s gonna get what’s due to her.

“What she said was bang out of order and an insult to little Rhys.”

And a 17-year-old girl added: “The little cow is running scared, and good riddance.”

Two other members of the Croxteth Crew were jailed for seven years for helping Mercer evade police and four more will be sentenced next year.

There's nothing quite like a bit of impartial journalistic integrity... and this is nothing like it.
